03.05.10 — Corporate Law Symposium: "The Globalization of Securities Regulation: Competition or Coordination?

After the enactment of Sarbanes-Oxley in 2002, influential voices in the business, political, and academic community expressed concern that the U.S. markets were losing their competitive advantage. While a number of factors were identified as contributing to this decline, higher U.S. regulatory compliance costs and liability risks were, in particular, singled out. Regulators, in turn, considered proposals that would ease barriers to entry. The 2008 financial meltdown increased awareness of the interconnectedness of markets and the importance of a coordinated approach toward securities regulation. At the G-20 Summit in April 2009, there was even talk of a global financial regulator that would regulate financial institutions within the U.S. borders. As policy makers, regulators and academics consider proposals for regulatory reform, how will these considerations—competition and coordination—play out?
